YOUR RESPONSIBILITY AS SURETY FOR A CRIMINAL
BOND
PLEASE READ CAREFULLY
You,
as surety, are entering into a Contractual Agreement to produce the individual
on the scheduled appearance date(s). At the time the bond is signed a lien will
be issued and placed against the property used and you will be required to pay
a $5.00 fee to cover the cost for filing the lien with the Clerk of Superior
Court. In addition, effective June 17, 2004, you will be required to pay a $13.00
bond posting fee, per bond. Upon the appearance of your principal in Court,
and disposition of the case, by providing documented proof of same to the Sheriff
of Glynn County, you will be issued a cancellation of lien, which you will file
with the Clerk of Superior Court accompanied by a $5.00 fee, per lien, to remove
said lien(s). If, on the Court date, you, as Surety, fail to produce the Defendant,
you have failed to meet the terms of the Contractual Agreement and you will
be required to pay the Court the sum of money specified in the Bond Agreement.
If payment is not made, a judgment will be placed against your property for
the amount of the bond plus Court cost. The Sheriff's Office is required by
the law to seize your property for public auction. Once the property is sold,
any proceeds exceeding the amount of the bond and Court cost will be returned
to you, the Surety. To be relieved of your Contractual Agreement prior to the
scheduled Court appearance of the Defendant, you must return physical custody
of the individual to the Sheriff's Office at the Glynn County Jail where you
will be issued an off-bond receipt. When you come off the bond, you will be
issued a lien cancellation, which you will file with the Clerk of Superior Court,
along with $5.00 filing fee per lien to have the lien(s) removed. Remember,
the Sheriff's Office cannot, by Georgia Law, arrest the individual for the sole
purpose of allowing you to go off the bond.
